Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Kingsley Heights rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

Since the 1st July of 2021, when a brand new or renewed lease is entered into on the Kingsley Heights rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

The person liable for this fine is whoever is named on the lease agreement as being the person who is letting the property, so it could be the name of the landlord or the property management company.

All information in the Compliance Statement requirements to be current at the time that the tenancy agreement is completed, and should be maintained through the tenancy period as associated work has been completed.

It is crucial to note that a landlord who have multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down for severe breaches, and landlords with more than six properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory throughout Kingsley Heights and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate conformance with each Healthy Homes Standard that apply or will be applicable during the tenancy of an apartment rental.

From 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Kingsley Heights

Kingsley Heights rental properties should have a permanent heating source which can warm the main or largest living space to at least 18degC, even during the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements for it to be permanent (i.e., not portable) with at least 1.5 horsepower in capacity, and it must have the minimum heating capacity needed to heat the living space in general.
